Terms and Conditions for Private Individuals

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers within the meaning of the Austrian Consumer Protection Act (KSchG) via the Austria Devils online shop at www.austria-devils.at.

By placing an order, the customer declares that they have taken note of and accepted the GTC in the currently valid version.

3. Offer and Prices

• All prices stated in the online shop are in euros (€) and include the statutory value-added tax (VAT).

• Prices are subject to change but will not affect orders already placed. The prices listed at the time of ordering apply to the contract.

• Deposit fees for beverage cans—if applicable within Austria—are shown separately and must be paid in addition to the product price.

4. Order and Conclusion of Contract

By clicking on “Order with obligation to pay”, the customer makes a binding offer to conclude a purchase contract.

Receipt of the order is initially automatically confirmed to the customer by e-mail (order confirmation). This order confirmation does not yet constitute a conclusion of contract.

The purchase agreement is only concluded when the order is expressly confirmed by Austria Devils (A. Devils e.U.) via email (order confirmation) or the goods are dispatched.

5. Payment

• The customer can choose between the payment methods offered in the online shop, in particular: instant bank transfer/EPS, credit card, PayPal, advance payment, or other payment options shown in the shop.

• Any transaction fees or additional costs incurred in connection with the chosen payment method will be clearly and transparently displayed before the order is completed.

• The purchase price is due immediately upon conclusion of the contract, unless otherwise agreed.

• If payment is made in advance, delivery will only take place after the full purchase price has been credited to the account of A. Devils e.U.

6. Delivery

• Delivery takes place within Austria and to selected EU countries, provided this is offered in the shop.

• The shipping costs are clearly displayed to the customer in the check out before the order is completed.

• The delivery time is usually 2–5 working days, unless otherwise stated.

• The customer will be informed immediately of any delivery delays.

• If the goods are not available at the time of delivery, A. Devils e.U. can postpone the delivery date or withdraw from the contract. Payments already made will be refunded immediately in this case.

7. Retention of Title

The delivered goods remain the property of A. Devils e.U. until full payment.

Ownership automatically passes to the customer upon full payment.

The retention of title does not affect the statutory rights of the consumer, in particular warranty rights.

8. Protection of minors (Energy Drinks)

By placing the order, the customer confirms that they are at least 14 years old.

A. Devils e.U. (Austria Devils) reserves the right to request proof of age (e.g., a copy of an ID card).

If proof of age is not provided or the age limit is not reached, A. Devils e.U. reserves the right to cancel the order and refund any payments already made.

9. Warranty

The statutory warranty provisions of the Consumer Protection Act (KSchG) apply.

Consumers have the right to assert warranty claims within the statutory period of 2 years if the delivered goods are defective.

Damage or defects should be reported as soon as possible, but no later than 2 weeks after receipt of the goods, by e-mail to m.kuntner@austria-devils.at, including meaningful photos or a description of the defect.

A. Devils e.U. will examine the defect and, at the consumer’s discretion, offer either repair, replacement, price reduction, or cancellation (withdrawal), as provided by law.

10. Liability

A. Devils e.U. is liable according to the statutory provisions for intent and gross negligence.

In the event of slight negligence, A. Devils e.U. is only liable for breach of essential contractual obligations (cardinal obligations), but not for lost profits or indirect damages, to the extent permitted by law.

This limitation of liability does not apply to damages resulting from injury to life, limb, or health based on a negligent breach of duty by A. Devils e.U., nor to mandatory consumer protection claims.

11. Return / Cancellation

Consumers have the right to withdraw from the purchase contract within 14 days without giving reasons. The period begins with receipt of the goods.

The right of withdrawal does not apply to:

• Food or perishable goods

• sealed drinks or other products where the seal or original closure has been opened or damaged for hygienic reasons.

Returns must be carefully packaged. The costs of the return are borne by the consumer, unless otherwise agreed.

12. Data Protection

A. Devils e.U. processes the customer’s personal data exclusively for processing orders, delivering the goods, and processing payments.

The data will only be passed on to third parties if this is necessary for the fulfillment of the contract (e.g., payment service providers, shipping companies).

Customer rights according to the GDPR (information, correction, deletion, restriction of processing, data portability, revocation of consent) remain unaffected.

13. Place of Jurisdiction / Choice of Law

Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers within the meaning of the Consumer Protection Act (KSchG): The place of jurisdiction is the consumer’s place of residence or a court with jurisdiction under the KSchG.

For entrepreneurs, Wels, Austria may be agreed as the exclusive place of jurisdiction.
